Interactive Brokers LLC is facing a lawsuit from David Castleman, the Court-appointed Receiver for EminiFX, in connection with the Ponzi-like scheme that allegedly defrauded investors. The Receiver accuses IBKR of negligence and aiding a breach of fiduciary duty in its handling of funds deposited by EminiFX’s founder, Eddy Alexandre, who is accused of running the fraudulent scheme.

The U.S. District Court for the Southern District of New York, presided over by Judge Valerie E. Caproni, appointed Castleman as Receiver following the Commodity Futures Trading Commission’s (CFTC) civil complaint against EminiFX and Alexandre in May 2022. The Receiver’s aim is to recover damages for the benefit of the defrauded EminiFX customers.

The lawsuit alleges that IBKR allowed Alexandre to deposit millions of dollars into his personal account in late 2021 and early 2022 despite being aware that these funds came from EminiFX investors. The complaint states that IBKR either knew or should have known about EminiFX’s fraudulent operations based on due diligence and its ongoing investigation.

According to the Receiver, tens of thousands of investors were under harm by IBKR’s actions, which enabled Alexandre to transfer more than $9 million into his personal account. Of that amount, $7 million was allegedly lost due to risky investments on IBKR’s platform. By the time the Receiver took control, only $1.75 million remained in Alexandre’s account, with total losses from the scheme amounting to $55.4 million.

In response, IBKR contends that the Receiver lacks authority to bring claims on behalf of EminiFX customers, as they are not part of the Receivership Estate. The broker also denies the claims of negligence, asserting that it owed no duty to non-customers. The case is ongoing in the New York Southern District Court.
